SUMMARY: The Parties agreed that a collision took place involving their vehicles on April 23, 2018, near Country Road (NW 3950) and Country Road (EW 2400) in Ochelata, Washington County, OK. Plaintiff alleged that Defendant was attempting to pass in a no passing zone and caused the collision with Plaintiff when she signaled and attempted to turn left into a private drive. As a result of the collision, Plaintiff suffered injuries to her neck and back. (Plaintiff did not submit any past medical bills.)
Defendant denied that he was in a no passing zone and that the zone was in an area between two connecting roads and did not apply to him. Defendant also claimed that Plaintiff was late in signaling and had been told by her husband that he thought Defendant was trying to pass. Defendant alleged that Plaintiff failed to keep a lookout and that her actions were the cause of the collision. Defendant also denied the nature and extent of Plaintiff’s injuries and claimed that she had similar complaints and treatment in the past.

The Jury found Plaintiff 40% negligent and Defendant 60% negligent.
The Jury awarded Damages to the Plaintiff in the amount of $5,000.00 which the Court reduced by the percentage of negligence assigned to the Plaintiff.
