SUMMARY: The Parties admitted that on December 12, 2017, Plaintiffs purchased a 2014 Hyundai Tucson from Defendants for $11,000.00. The vehicle was advertised as “runs like new, clean title, safe and reliable.” Plaintiffs took out a loan from Tinker Federal Credit Union to pay for the vehicle.
Plaintiffs alleged that they started to have issues with the vehicle shortly after the purchase. They took the vehicle to a Hyundai dealership and were informed that the vehicle had evidence of high-water damage, had parts missing and was unsafe. Plaintiffs claimed that they returned the vehicle to Defendants, but they refused to take it back and refused to refund their money. Plaintiffs also claimed that Defendants were negligent in their attempts to repair the vehicle by failing to insure that the repairs were consistent with the manufacturer’s specifications and requirements. Plaintiffs sought damages for the purchase price, interest they had to pay on the loan, taxes and insurance. Plaintiffs had to store the car because of its claimed unsafe condition and sought damages for the purchase of another car to drive.
Defendants denied Plaintiffs’ allegations and claimed that there was nothing wrong with the vehicle. Defendants also claimed that the car had been damaged by Plaintiffs when they tried to access the motor.

SUMMARY: Plaintiffs alleged that on August 31, 2018, Susan Brown was driving a vehicle occupied by her husband, Gary Brown, at the intersection of 112th Street and N. Rockwell in Oklahoma City, OK. Plaintiffs claimed that they were stopped and were waiting for traffic to clear so that they could make a left turn. When the light turned red, they attempted to complete the turn when their vehicle was struck by Defendant. Plaintiffs alleged that Defendant was confronted by a yellow light and then a red light but failed to stop before colliding with Plaintiffs’ vehicle in the middle of the intersection. As a result of the collision, Susan Brown claimed she sustained injuries of a concussion with lasting cognitive issues, an ankle injury and the need for a future surgery for a torn rotator cuff. (No past medical bills were presented.) Gary Brown claimed he sustained soft-tissue type injuries and issues stemming from a loss of consciousness. Plaintiffs also sought damages for lost income and impairment of earning capacity for their computer technical company.
Defendant denied that he failed to yield to a red light and disputed Plaintiff’s claim that her vision was obscured by other vehicles. Defendant alleged that Plaintiff failed to yield to his vehicle which had the right of way at the intersection. Defendant also denied the nature and extent of all Plaintiffs’ damage claims.

SUMMARY: Plaintiff alleged that on April 23, 2019, during a heavy rainstorm, near the intersection of I-35 and Britton Road, the Defendant’s vehicle rear-ended her vehicle causing damage to the rear bumper and taillight. The impact caused her vehicle to spin and be struck a second time on the driver’s door. As a result of the collision, Plaintiff incurred medical bills of over $100,000.00 (which were reduced pursuant to 12 OS 3009.1 to approximately $45,000.00) for undergoing a spinal fusion surgery along with other injuries.
Defendant denied liability for causing the accident. Defendant claimed that Plaintiff was driving a vehicle with excessively worn tires which failed to meet the statutory tread depth. Defendant alleged that this condition and excessive speed led to Plaintiff hydroplaning in front of Defendant and resulted in a single collision to her driver’s side door. That collision caused Plaintiff to spin into a cable barrier which caused the damages to her rear bumper and taillight.

Jackie Cooper Imports denied any wrongdoing, relying on the fact that the customer took the vehicle on three test drives and that he knew and understood the Vehicle was used and was being sold AS-IS.
