SUMMARY: Plaintiff, an African American man, worked as a patient transporter for Defendant. Plaintiff alleged that he was terminated by Defendant after a Caucasian certified nurse assistant (CNA) made a complaint of sexual harassment. The CNA alleged that Plaintiff had asked her to come with him to find a fallen patient and, when she got on an elevator with him, he put the elevator on hold and sexually harassed her. In addition, during the investigation, Defendant claimed that Plaintiff had interfered with the investigation by returning to the hospital to talk to the CNA and other witnesses after being suspended. Plaintiff denied that he had been told he could not return to the hospital during the investigation and alleged that the CNA was allowed to stay at work and contact witnesses without repercussions. Plaintiff denied that he harassed the CNA or interfered with the investigation. Plaintiff asserted that the elevator could not even be stopped without an alarm being sounded. Plaintiff argued that the investigation and his termination was biased and brought his claim for race discrimination. Defendant denied that the investigation and Plaintiff’s ultimate termination was biased. Defendant relied upon statements made by the Plaintiff that were proven to be false by way of video evidence as well as interviewing nine witnesses, several of whom were also African American, who directly contradicted Plaintiff’s story on key facts. Defendant also claimed that the Plaintiff’s interference as a basis of termination was stated on the Summary of Internal Investigation created prior to Plaintiff’s termination.

SUMMARY: Plaintiff was a resident at Defendant’s sixteen-unit housing complex in Vici, OK. The apartment complex provided low-income housing to individuals who qualified for rental assistance through the US Department of Agriculture Rural Development Division’s rental assistance program. Defendant, Arnold, was the property manager. Plaintiff alleged that the Defendant’s engaged in discriminatory conduct in violation of several sections of the Oklahoma Discrimination Housing Act as well as violations of various sections of the Federal Fair Housing Act and CARES Act. Plaintiff claimed she was discriminated against because of her disability by refusing to renew her apartment lease and failing to recertify her for housing. Plaintiff also alleged that she was required to deliver her rent personally to the office while others were not required to do so. Plaintiff also claimed that she was not allowed to pay her rent later in the month after requesting an accommodation; that Defendant had refused to accept her timely tendered rent in the month following her alleged lease agreement expiration; and, that Defendant concealed that the rent obligation was $300.00 rather than the $309.00 which was being charged. Plaintiff also alleged that Defendant treated her in a retaliatory manner after she filed a complaint with HUD. Plaintiff also claimed she was retaliated against because she was a witness in another resident’s prior discrimination claim which was later dismissed. Defendants denied all the allegations of Plaintiff. Defendants alleged that Plaintiff was not handicapped or disabled within the meaning of the FHA or ODHA and that she had repeatedly failed to timely pay her rent in the correct amount along with other violations of her lease agreement. Defendants alleged that they had accommodated her request to pay rent later in the month, but that Defendant did not comply with the agreement. Defendant asserted that they had legitimate, non-discriminatory and non-retaliatory reasons for the actions taken relating to Plaintiff.
VERDICT: Jury Trial (Four Days)
(Prior to trial, the following claims were Dismissed by Order of the Court:
• Plaintiff’s claims under the Fair Housing Act, 42 USC 3604(f)(1)(C) and 42 USC 3604(f)(2)(C), and Plaintiff’s request for Declaratory Judgment based on the Dept. of Agriculture’s regulations, 7 CFR 3560.159 and 7 CFR 3560.160.) (At trial, Defendants’ Motion for Judgment as a Matter of Law was Granted with respect to:
• Plaintiff’s Breach of Contract against Vici Community Development Corp.
• Plaintiff’s Fair Housing Act (Section 3617) retaliation claim; Okla. Anti-Discrimination Act (Section 1601.1) claim; and Rehabilitation Act (Section 504) claim to the extent those claims were based on testifying on behalf of Judy McAdoo in McAdoo’s prior discrimination claim.) On the remaining claims at trial, the jury found in Favor of the Plaintiff as follows:
• In Favor of Plaintiff and Against the Defendants for compensatory damages for emotional pain and mental anguish in the amount of $2,700.00.
• In Favor of Plaintiff and Against Defendant, Vici Development, on the Rehabilitation Act discrimination and retaliation claims in the amount of $1.00 as nominal damages.
• In Favor of Plaintiff and Against the Defendants on the Oklahoma Consumer Protection Act claim relating to the rent obligation in the amount of $27.00.
• In Favor of Plaintiff and Against Defendant, Vici Development, on the Oklahoma Consumer Protection Act for penalties in the amount of $5,600.00.
• In Favor of Plaintiff and Against Defendant, Cindy Arnold, on the Oklahoma Consumer Protection Act for penalties in the amount of $700.00.
• In Favor of Plaintiff and Against Defendant, Vici Development, for punitive damages in the amount of $250.00
• In Favor of Plaintiff and Against Defendant, Cindy Arnold for punitive Damages in the amount of $250.00.
