As a business owner, one of your biggest fears may be getting hit by an unjustified personal injury lawsuit. While the majority of people bringing claims generally have a valid reason, some are willing to make false claims in the hope of gaining some “easy” money. Others may have a valid claim, but exaggerate the severity of it for their own profit.
Fighting these claims is not just something you may want to do on principle, but may also be necessary to preserve the finances of your business. One tool you may have at your disposal is the social media accounts of the person who is trying to claim against you. People often seem to forget themselves when using it and often post something that can shed light on the true reality of the situation, and thus be useful to you when fighting the claim.
Photos or videos on a litigant’s social media may help you
Many people like to post photos or videos of themselves doing things. If you look carefully, you may find a claimant posts an image of themselves doing something that, according to the injury reports they are presenting you with, should not be possible for them. For example, the person who claims they suffered a neck injury in a collision with one of your drivers should not be able to dive into a pool, as their social media feed clearly shows them doing. Or maybe the claimant who says they cannot work at their old job because it involved lifting is there in the background of a photo, lifting a child.
Comments can also be a clue to the reality of the situation
Maybe you see the claimant who tells you they’ll need to be off work for 12 months, reply “ Much better, thanks” in reply to someone’s question about how their injury is. Or, maybe you see a comment where someone jokes about how they have fooled everyone.
With help from a defense team that knows what to look for, you can improve your chances of beating any unjust claims against you.
